Terms of Service

PowerfulU is a software platform that helps independent fitness and wellness coaches run their coaching business — managing clients, building programs, exchanging messages, collecting check-ins, tracking progress, and (optionally) accepting payments. Coaches deliver their own services to their own clients; PowerfulU provides the software they use to do it.

PowerfulU is a fitness coaching platform, not a medical provider. Health documents and other information stored on the Service are for coaching reference only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition.

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information, to keep it up to date, and to keep your login credentials confidential. You are responsible for all activity that happens under your account.

If you set up an encryption password or a recovery key to protect health documents, you are solely responsible for keeping them safe. Because your documents are end-to-end encrypted, we cannot reset your encryption password or recover your documents if you lose both your password and your recovery key.

Coaching services are provided by individual coaches, not by PowerfulU. PowerfulU is not a party to the coaching relationship and does not supervise, direct, or control any coach’s services. Any advice, programs, or guidance a coach provides are the coach’s own. Coaching advice is not medical advice.

Clients join a coach using that coach’s invite link. A coach may end a coaching relationship at any time; when a relationship ends, the client is archived and the coach’s access to any documents the client shared is revoked immediately.

You may choose to upload health documents (for example, lab or blood results). These are encrypted on your device before upload using end-to-end encryption, so only you — and any coach you explicitly choose to share a document with — can decrypt and read them. PowerfulU stores only encrypted data and has no ability to read your documents.

For each document you upload, you choose whether to keep it private (visible only to you) or share it with your coach. You can change a document’s sharing setting, or permanently delete the document, at any time. When you delete a document it is permanently removed from storage with no recovery.

You are responsible for ensuring you have the right to upload any information you provide and for deciding what to share. Do not upload information about anyone other than yourself without their permission.

Coaches may only access a health document when the client has chosen to share it and the coaching relationship is active. We record when a coach opens a shared document and show that to the client (“Your coach viewed this document on [date]”). When a client unshares a document, or a coaching relationship ends, the coach’s ability to decrypt and view that document is revoked immediately.

Coaches agree to use shared health documents strictly for coaching purposes and not to provide medical interpretations of them.

You acknowledge that fitness and wellness activities carry inherent risks and that you participate voluntarily. The Service, and any coaching delivered through it, is not medical care. To the fullest extent permitted by law, you release PowerfulU from any claims arising out of fitness or wellness activities, from reliance on coaching guidance, or from any health outcome. Consult a physician before beginning any new fitness, nutrition, or wellness program.

Coaches can use PowerfulU on a free plan (up to 3 clients, full features) for as long as they like. Paid plans unlock more capacity and visibility: Standard at $59.00 per month (up to 250 clients) and Verified at $99.00 per month (everything in Standard, plus the Verified Coach badge and directory listing). Paid subscriptions automatically bill each month until cancelled. If your account includes a free trial period, you will not be billed until the trial ends.

You can cancel anytime from your billing settings (managed through Stripe’s billing portal). Cancellation stops future charges; fees already paid are non-refundable except where required by law. We may change subscription pricing on prospective notice.

Coaches may optionally charge their clients a recurring membership through the Service. Client payments are processed via Stripe Connect directly to the coach’s connected account. PowerfulU retains a platform fee of 2% of each client payment; the remainder goes to the coach. The coach sets their own membership price.

Coaches are responsible for the services they charge for, for any refunds to their own clients, and for their own taxes. PowerfulU is not the seller of coaching services and is not responsible for disputes between a coach and their clients.

All payments are processed by Stripe. PowerfulU never stores your full card details on our servers — card data is collected and handled solely by Stripe under their terms and security standards. By making or receiving payments through the Service, you also agree to Stripe’s applicable terms.

You agree not to:

• use the Service for anything unlawful, harmful, deceptive, or abusive;
• upload content you don’t have the right to upload, or that infringes others’ rights;
• attempt to access another user’s account, data, or encrypted documents;
• probe, scan, or circumvent the security or access controls of the Service;
• provide medical diagnosis or treatment to clients through the Service;
• resell, scrape, or build a competing product from the Service.

The Service, including its software, design, and content provided by us, is owned by PowerfulU and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You retain ownership of the content you create or upload; you grant us only the limited rights needed to host and operate the Service for you (note that we cannot access the contents of your end-to-end encrypted documents).

You may delete individual documents at any time, and you may delete your account at any time. Deleting your account permanently deletes all of your health documents and progress photos and your associated records, with no recovery. We retain limited records where required for legal, tax, or fraud- prevention purposes.

We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as disclaimers, liability limits, and indemnification) will survive.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any coaching outcome will be achieved.

To the fullest extent permitted by law, PowerfulU and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or US $100.

You agree to indemnify and hold harmless PowerfulU from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your coaching services (if you are a coach), or your violation of these Terms or of applicable law.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and PowerfulU agree to first try to resolve any dispute informally by contacting us. If we can’t resolve it, disputes will be handled by the state or federal courts located in California, and you consent to their jurisdiction, except where applicable law gives you the right to a different venue.

We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date and, where appropriate, notify you in the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
